📝 Car insurance

I was involved in a accident. The driver passed out and totaled my car. I had high mileage for the years I've had it but the car was paid off in good condition. Clean record and had regular maintenance. The other driver was determined to be at fault but sent a letter stating his insurance might not have enough coverage to handle all the property damage since he knocked over a traffic light. They said I am unable to put in a claim with them and I have to go through my insurance. My insurance is giving me a low value for my car. I know this because I can't find a similar car without paying thousands out of pocket. I asked my adjuster and her supervisor for help but they said they don't owe me a like replacement. They only owe what they value the car at. They sent me card that were previously rentals, involved in accidents, and have more mileage than my car had, and even then I'll have to pay out of pocket. I sent them the total cost of the "comparable" cars back showing they are more than I'll be receiving. I also sent a list of cars on a 50 mile radius that I feel I would be down grading with that are still more than they are offering. They keep saying it's the mileage that's the issue but I said if that's true why can't I find a car with similar mileage for that price. They won't budge..I'm not asking for a lot extra, just enough to buy a similar used car that will allow me not to be in a worse off financial situation. Do I have any rights? I have injuries (whiplash l, back pain, etc..the guy was accelerating as he approached me so the accident was hard). Should I get a lawyer? AITA for trying to fight, thinking of getting a lawyer?
