Hello everyone the situation never really happened to me so this is why I'm asking for advice. So we bought a new house recently on new land and the series of homes nearby have existed for quite some time and The neighbor Next door is not used to having a neighbor because the house was built from the ground up and now they have some weird banana tree or palm tree that has a lot of big leaves and since we have a pool they are falling on the pool and we have to keep taking them out and it takes some time it's a job that me and my mom do but it can get pretty annoying over time especially now that we are entering the summer season and we want to use the pool everyday and have guests over and then the leaves look messy and the neighbors' fences are not high enough to stop them from falling over and it can get annoying and unnecessary really.
I don't know how nice they are I don't really know the neighbor but I am choosing one of three scenarios so number one is asking if I can dump the leaves onto their side so that's a problem of their side and not mine I would still have the work to clean the pool every day or every week on the off season, but at least they would keep the the foliage and use compost with it, or be reminded that they have to fix a problem otherwise their trash is going to end up on their backyard which is where it belongs. scenario number two is proposing a deal in which they compensate me in some manner for not being able to prevent the leaves from falling because it would be very difficult and very anaesthetic to make a fence that is high enough for the leaves not to fall on my property and their tree's branches are already grown a bit on top of our property so that would require trimming half the tree because the tree has grown above the pool the tree was already there. Our house is new but still it's something hard to undo and would require them to alter their tree destructively and that could be avoided. scenario number three is demanding them to make a fence/wall on top of the existing one and if they don't I'm taking them to court. I don't know if this would work or if this would bring problems that the rule of law will not solve but it seems to be the most extreme. I don't know what to do really I want to to do something that is effective but that does not disrupt the Peace of the neighbor but also that does not make my life harder without necessity so would I be the a****** for proposing these deals or should I just take them to court immediately over this Thank you
