📝 AITAH for not quitting smoking?

Okay so basically I am with my now boyfriend, and he used to smoke but he is now on probation, for personal reasons I will not disclose. Due to him being on probation though, he can’t smoke weed anymore for his back pain (it’s not serious enough to where he needs a medical card). He has know since the day we met that I smoked, and wasn’t willing to quit just for a relationship right now, and he was perfectly okay with this from the start. We got about a month into being together and that’s when I started noticing small issues here and there with my smoking, one of those being I didn’t tell him before I did and then he had got mad I fell asleep early at like 8pm. Another time, I had asked him if I could smoke with he was in his graphic design class, and all he said was “ig” like wtf dude. So I stopped telling him when I smoked, and he hasn’t even noticed at all, he can’t tell when I am under the influence or using so why does it matter so much if I do. It has even gotten to the point where I threw my dab pen across the room breaking it during a fight ON THE PHONE (we are long-distance), because he would keep saying I could and then get mad at me later if I actually did. I have talked to him about this so many times telling him I need a straight answer and he says that, “I’m okay with you smoking if we aren’t doing anything, just not when we are having an actual important conversation”. I had fully agreed to this, but it feels like he is always mad at me if I smoke and it’s almost like he has been happier with me when I don’t tell him. I have no clue if I should start asking again, or keep it how things are going since he doesn’t notice anyway and it isn’t bothering anyone.

Edit: A comment had said something about him being on probation and how I won’t talk about it, and that is for his own privacy and I can confirm if was to do with illegal THC, and nothing to do with domestic abuse, and I threw the dab pen, not him and we are long-distance
